What is needed to stop wage garnishment for spousal support and back child support when the ex spouse passes.?
A friend who is currently paying back child support and spousal support through wage garnishments wants to stop it as his ex just passed away. What does he need to show the court, a death certificate?

How old is the child? He might still have to pay if the child is not with him!! They might just be forwarding it to someone else!!
it is BACK child support and spousal support. yes take a copy of the death certificate and a copy of the payment agreement.they will need the cause number. the kids are grown and gone correct?
Your friend may be able to go to court and see about getting rid of future spousal support because the ex passed away.
They will most likely be stuck paying off the back child support and back spousal support. The back child support would be considered money that is already owed to the ex’s estate.
In other words…this money was already owed to them and would be part of the ex’s estate.
He needs to go down to the child support office in person and tell them what has happened. If he wants to go throught he courts he can do that but it will take longer, you can get all the papers off the internet that you would need to make yourself a court date. I would suggest the other way. If the child is going to be living with someone other than him, he will need to go through everything again, as far as the paperwork. He will have to pay child support to who ever has the child. All back support oweing will be wiped clean. Good Luck
